1. Protection of your privacy is very important for us. We understand clearly that you and your personal information is one of our most important assets. We store and process your information including any sensitive financial information collected, if any, on computers that may be protected by physical as well as reasonable technological security measures and procedures in accordance within the meaning of the applicable law. The personal information/data provided to us by you during the course of usage of Nexter Plus will be treated as strictly confidential and in accordance with the Privacy Policy and applicable laws and regulations.
2. If you use the Nexter Plus, you shall be responsible for maintaining the confidentiality and security of the account information, and are fully responsible for all activities that occur under your account. You agree that if you provide any information that is untrue, inaccurate, not current or incomplete or we have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, or not in accordance with these Terms & Conditions, we shall have the right to indefinitely suspend or terminate or block access of your membership on the Nexter Plus and refuse to provide you with access to the Nexter Plus. You agree to immediately notify Nexter Plus of any unauthorized use/breach of your account information and ensure that you exit from your account at the end of each session.
3. During the course of your use of the Nexter Plus, you may receive information relating to us or our affiliates or to the services that is not known to the general public and you will treat it “Confidential Information” and will not disclose to the general public or anyone. You agree that all information will remain Nexter Plus’s exclusive property; you will use “Confidential Information” only as is reasonably necessary for your participation in the Nexter Plus and ensure that persons who have access to “Confidential Information” will be made aware of and will comply with the obligations in this provision; and you will not otherwise disclose “Confidential Information” to any individual, company, or other third party, including any affiliates. You may not issue any press release or make any public statement related to the Nexter Plus, or use our name, trademarks or logo in any way (including in promotional material) without our advance written permission, or misrepresent or embellish the relationship between us in any way.
4. Nexter Plus cannot and will not be liable for any loss or damage arising from your failure to comply. You may be held liable for losses incurred by Nexter Plus or any other user of or visitor to the Nexter Plus due to authorized or unauthorized use of your account as a result of your failure in keeping your account information secure and confidential. You shall ensure that the account information provided by you in the Nexter Plus‘s registration form is complete, accurate and up-to-date. Use of another user’s account information for availing the Information, Products and Services is expressly prohibited.
5. You shall not engage in advertising to, or solicitation of, other users of the Nexter Plus to buy or sell any Information, Products and Services, including, but not limited to, Information, Products and Services related to that being displayed on the Nexter Plus or related to us. You may not transmit any chain letters or unsolicited commercial or junk email to other users via the Nexter Plus. It shall be a violation of these Terms & Conditions to use any information obtained from the Nexter Plus in order to harass, abuse, or harm another person, or in order to contact, advertise to, solicit, or sell to another person other than us without our prior explicit consent. In order to protect our users from such advertising or solicitation, we reserve the right to restrict the number of messages or emails which a user may send to other users in any 24 hrs period which we deems appropriate in its sole discretion.
6. You understand that we have the right at all times to disclose any information (including the identity of the persons providing information or materials on the Nexter Plus) as necessary to satisfy any law, regulation or valid governmental request. This may include, without limitation, disclosure of the information in connection with investigation of alleged illegal activity or solicitation of illegal activity or in response to subpoenas, court orders, or other legal process. In addition, we can (and you hereby expressly authorize us to) disclose any information about you to law enforcement offices, or other government officials, as we, in our sole discretion, believe necessary or appropriate in connection with the investigation and/or resolution of possible crimes, especially those that may involve personal injury and also disclose any information about you to third party rights owners, or others in the good faith belief that such disclosure is reasonably necessary to provide you access to our Information, Products and Services, to comply with our legal obligations, to enforce our Terms & Conditions or Privacy Policy; to facilitate our marketing and advertising activities, or to prevent, detect, mitigate, and investigate fraudulent or illegal activities related to our Information, Products and Services, respond to claims that an advertisement, posting or other content violates the rights of a third party; or protect the rights, property or personal safety of our users or the general public. We may share personal information with our other corporate entities and affiliates. These entities and affiliates may market to you as a result of such sharing unless you explicitly opt-out. If you object to your information being transferred or used, please do not use the Nexter Plus.
7. We and our affiliates will share/sell some or all of your personal information with another business entity should we (or our assets) plan to merge with, or be acquired by that business entity, or re-organization, amalgamation, restructuring of business. Should such a transaction occur that other business entity (or the new combined entity) will be required to follow this Privacy Policy with respect to your personal information.
8. Parties other than Nexter Plus and its affiliates may operate stores, provide or sell Information, Products and Services on Nexter Plus. We are not responsible for examining or evaluating, and we do not warrant or endorse the offerings of any of these businesses or individuals, or their content which they offer via Marketplace. Nexter Plus does not assume any responsibility or liability for the actions, Information, Products and Services, and content of any of these and any other third-parties. You can tell when a third-party is involved in your transactions, and we may share customer information related to those transactions with that third-party. You should carefully review their privacy policy and other terms & conditions. We will not be responsible for any business loss (including loss of profits, revenue, contracts, anticipated savings, data, goodwill or wasted expenditure) or any other indirect or consequential loss that is not reasonably foreseeable to both you and us when you commenced using the Marketplace.
9. You agree to provide correct and accurate financial information, such as credit/debit card details to the approved payment gateway or pre-paid payment instrument account details for availing Information, Products and Services on the Nexter Plus. You shall not use the credit/debit card or pre-paid payment instrument which is not lawfully owned by you, i.e. in any transaction, you must use your own credit/debit card or pre-paid instrument account. The information provided by you will not be utilized or shared with any third party unless required in relation to fraud verifications or by law, regulation or court order or in accordance with the terms of the Privacy Policy. You will be solely responsible for the security and confidentiality of your credit/debit card details or pre-paid instrument account.
10. Nexter Plus expressly disclaims all liabilities that may arise as a consequence of any unauthorized use of your credit/debit card or pre-paid instrument account. In addition to these Terms & Conditions, the terms and conditions of the bank or other financial institution shall also be applicable to every user. The Nexter Plus disclaims any liability arising out of declining of payment by such bank or financial institution. In case of suspicious transactions, Nexter Plus reserves the right to inform law enforcement officials and provide them with all transaction details that may be requested for investigation of any illegal activity. Nexter Plus reserves the right to refuse access to the Nexter Plus, terminate accounts, remove or edit content at any time without notice to you. Depending upon whether you are a seller or a buyer or another user who otherwise wish to use the Nexter Plus, and the nature of Information, Products and Services you wish to avail from the Nexter Plus, you may be required to provide certain personal information and Nexter Plus may collect certain personal information. Your provision of, and Nexter Plus‘s collection, storage, use, disclosure and otherwise dealing of such personal information shall be governed by Nexter Plus‘s Privacy Policy.
11. It is possible that other users (including unauthorized users or “hackers”) may post or transmit offensive or obscene materials on the Nexter Plus and that you may be involuntarily exposed to such offensive and obscene materials. It also is possible for others to obtain personal information about you due to your use of the Nexter Plus, and that the recipient may use such information to harass or injure you. We does not approve of such unauthorized uses, but by using the Nexter Plus you acknowledge and agree that we are not responsible for the use of any personal information that you publicly disclose or share with others on the Nexter Plus. Please carefully select the type of information that you publicly disclose or share with others on the Nexter Plus.
